Cafeteria Inc. (“Cafeteria”, “we” or “us”) knows that your privacy is important to you, and we want you to know that it is important to us too. When you use our website or mobile application (collectively, “Services”), we may collect and process certain information about you and your activities in relation to our Services, including information that is considered “personal information” or “personal data” under applicable laws (“Information”).
This Privacy Notice (“Notice”) describes how we collect, use, process and disclose your Information in connection with our Services. This Notice also details how we protect your Information and choices you may have with respect to your Information. This Notice only applies to the Services where this Notice is posted or otherwise made available. This Notice should be read in conjunction with our Terms of Service.

Information We Collect and How We Collect It
In the course of your use of the Services, we may use different technologies and ask you to provide us with certain Information to help us provide and improve the Services, to contact or identify you, to enable you to access certain parts of the Services, or as otherwise indicated in this Notice. We may collect the following Information about you in the following ways:
a. Information You Provide to Us
When interacting with our Services, you may provide information to us. This may include:
- When you create an account or register for our Services, we collect certain Information, such as your name, your or your parents’ email address, phone number, age, date of birth, gender, and your general location, such as your zip code. We also may collect a photograph or image of you if you choose to upload one as part of your profile.
- When you communicate with us through the Services, via email, or with our customer support, we may receive certain Information, such as your name, email address, phone number, or other information you provide or is included in such communications.
- When you participate in our surveys (also known as “tables” within our app) and respond to questions made available on the Services, we may receive information about your personal or professional interests, lifestyle, favorites and opinions about various topics, programs, services or products (e.g., your favorite television shows, foods, clothing styles, brands, restaurants, etc.) and any other information you choose to include in your responses. You may provide us such information by responding to questions in our app or in the form of voice memos. If you choose to provide a voice memo, we will receive a recording of your voice.
- To compensate you for your participation in our surveys (i.e., when you respond to certain questions or surveys made available on the Services), we will collect your mobile payment application username or handle, such as your Venmo or Cash App username.
b. Automatically Collected Information
When interacting with our Services or marketing emails, our servers automatically collect certain information from your devices, including:
- Device information: this includes Information, such as your device ID, the browser you are using and its display settings, your operating system, device type, session start/stop time, time zone and network connection (e.g., Wi-Fi, cellular).
- Internet or other electronic network activity information – our Services may collect or use your internet protocol (IP) address, unique identifiers and other information regarding your interaction with our Services.
- Geolocation Data – our Services may use information regarding your general location. We do not collect or process precise geo-location data.
- Usage Data – We also collect information regarding your interactions with our Services. This Information includes your activities on our Services (such as the links you click, the page you visited before navigating our Services, the content you view, hover or click on and search terms you enter on our Services) and usage patterns (such as the length of time you use our Services, access times, page load times, and updates to your profile or account).
We and our service providers (such as our analytics providers) may collect the Information above through the use of tracking tools such as cookies, pixels, JavaScript, web beacons and SDKs. How We Use Your Information
We may use your information for the following purposes:
- a. Provision of Services - for the provision of our Services, including management and administration of our website and application, provision of technical or other customer support to resolve technical issues, provision of consumer insights to our Consumer Brand Partners and provision of a customized experience (for example, by remembering choices you make when you use the Services).
- b. Recruitment of Survey Respondents - we use your Information to inform you of what surveys (including surveys provided by our Consumer Brand Partners) are available on our Services. We may also use your Information to evaluate which surveys may be of interest to you and send you notifications about new available surveys and invitations to participate. If you choose to participate, following completion of the survey, we may use your Information to compensate you for your participation. At times we may make available questions or surveys that do not offer the respondent any compensation, but this will be made clear in our Services. Please refer to our Terms of Service for more information regarding our requirements for compensation.
- c. Communications - we use your Information to communicate with you and respond to your inquiries or requests regarding your account and our Services, including by email, push notifications, or texts, about your account, changes to our policies, customer service inquiries, to request feedback or to keep you informed of our latest updates to our Services.
- d. Marketing and advertising purposes - we may use your Information to send you promotional materials, such as marketing emails, concerning our Services.
- e. Improvement of our Services - we may conduct questionnaires or test features, and analyze the Information we have to develop, maintain, measure and improve our Services.
- f. Operate our business - to support our internal business functions, including finance, accounting and audit.
- g. AI Tools - we use software applications that incorporate artificial intelligence technology and machine learning (“AI Tools”) to provide certain features on our Services. We may use your Information to train these AI tools to enable us to build new products, improve our services and/or offer new services.
- h. With your consent - we may use your Information with your consent for other purposes described at the point of collection.
- i. Protecting our interests - we may use your Information when we believe it’s necessary in order to take precautions against liabilities, investigate and defend ourselves against any third-party claims or allegations, investigate and protect ourselves from fraud, protect the security or integrity of our Services and protect the rights and property of Cafeteria, its users and/or partners. We also may use your Information in order to enforce our policies and Terms of Service.
- j. Maintenance of security and compliance with legal and regulatory requirements - we may use your Information to detect and prevent fraud by verifying your identity, maintain the integrity and security of the Services, investigate violations, and as otherwise required by law, regulation or other governmental authority, or to comply with a subpoena or similar legal process.
How and With Whom We Share Your Information
We may disclose the Information that we collect or you provide as described below:
- a. Affiliates – we share your Information with our subsidiary and affiliated companies.
- b. Vendors and Service Providers – we share your Information with third-party vendors and service providers that perform services for us or on our behalf, such as website or system hosting, cloud hosting, data analytics, IT infrastructure services, and email delivery services.
- c. Consumer Brand Partners – we partner with popular consumer brands (“Consumer Brand Partners”) to provide market research and consumer brand insights gathered from Information you may provide in connection with the Services, including through responses to surveys we and our Consumer Brand Partners make available on the Services. If you choose to participate in these surveys, we will, at your direction, share your responses and non-personal information such as your age, gender and zip code with our Consumer Brand Partners, who may use such information for their own purposes, including but not limited to market research purposes. We do not share your name, phone number or any other directly-identifying information with Consumer Brand Partners.
- d. Others – we may disclose your information with our professional advisors including lawyers, auditors and insurers, and other parties if you ask, authorize or direct us to do so.
- e. Compliance with Laws and Enforcement Entities – we may disclose your Information (i) if we are required to so by law or legal process, such as a court order or subpoena; (ii) in response to requests by government agencies, such as law enforcement authorities; (iii) to establish, exercise or defend our legal rights (e.g., to enforce our Terms of Service); (iv) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; or (e) in connection with an investigation of an investigation of suspected or actual illegal activity.
- f. Mergers and Acquisitions – we may share your Information if we enter into a business transaction, such as a merger, divestiture, acquisition, restructuring, reorganization, dissolution, consolidation, bankruptcy, liquidation, or other sale or transfer of business transaction involving all or part of our company or assets or wind down of business, including for the purposes of determining whether to proceed with such transaction. Any party that acquires our assets as part of such transaction may continue to use your Information in accordance with the terms of this Notice.
- g. Deidentified and Aggregated Information – we may aggregate and/or de-identify your Information such that it is no longer able to be linked to you or your device(s). This Notice does not limit our ability to use or disclose such aggregated or de-identified information, which we may disclose in our sole discretion, including but not limited to any aggregated insights we may share with our Consumer Brand Partners.
Cookies and Other Tracking Technologies
A cookie or other tracking technology is a small piece of script or code that is stored on your browser or device to help websites and applications remember you and collect information about your use of the website or application. When you interact with our Services or our marketing emails, we may use cookies or other tracking technologies, such as pixels, web beacons, or SDKs to automatically collect information about you, your device and your online behavior (such as your IP address, web browser, mobile network information, pages viewed, time spent on pages, and links clicked). These technologies help us (i) remember your information so you do not have to re-enter it; (ii) track and understand how you use and interact with our Services; (iii) perform analytics and measure the usability of our Services and effectiveness of our marketing communications; (iv) customize the Services around your preferences; (v) authenticate your identity and protect against fraud; and (vi) otherwise manage, enhance our Services to ensure they are working properly. Financial Incentives
If you choose to participate in our surveys, you agree to the use of your responses as described in this Notice, and we may compensate you for your participation. By participating in any of our surveys, you agree to, and we will at your direction, share your responses with Consumer Brand Partners. Under certain U.S. state privacy laws, our payment to you may be considered a “financial incentive.” If you do not agree to our use of your responses as described in this Notice, including our disclosures to Consumer Brand Partners, you may decline to participate.
Your Rights and Choices With Respect To Your Information
a. Email Communication Preferences
You may opt out of receiving promotional emails from us by clicking on the “Unsubscribe” link at the bottom of the email. You also may tell us that you do not want to receive our promotional messages by emailing us at privacy@cafeteria.com. Please understand that it may take us a few days to process any opt out request and that even if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.
b. Browser and Device Settings and Push Notifications
Your browser may tell you how to be notified about certain types of tracking technologies and how to restrict or disable them. To learn more about how to manage cookies on different browsers, you can visit the website www.allaboutcookies.org. Note that blocking these technologies may prevent you from being able to use some or all of the features of our Services. For mobile devices, you can manage how your browser and device share certain data by adjusting the privacy and security settings on your device settings. Your browser may also permit you to send do-not-track signals or other similar signals to express your preferences regarding online tracking. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We do not currently respond to such signals.
If you have opted-in to receive push notification on your device, you can opt-out at any time by adjusting the permissions on your device or uninstalling our application.
c. Text Messaging
By submitting your mobile phone number, you consent for us to send informational text messages about Cafeteria Inc. and our Services to the mobile device associated with that number using an automatic system. Your wireless carrier may charge fees for text messages. Message and data rates may apply. Mobile internet access is required. You may elect to no longer receive communications to your mobile device by contacting us at privacy@cafeteria.com or texting “Stop” in response to any message. Your opt-out will be effective after we send you a confirmation. You will then be placed on our “do-not-contact” list for marketing purposes.
You represent that you are legally competent and have legal authority to form a contract and provide this consent with regard to the phone number you provide and that you reside in the United States. You may not consent on behalf of someone else or provide someone else’s phone number.
d. Individual Rights
In addition to the rights noted above, depending on your state of residence, you may be afforded, in accordance with applicable law, certain other rights with respect to your Information, such as the right to access, correct, delete or obtain a copy of the personal information we have collected about you. Data Security
The security and confidentiality of your Information is very important to us. We have implemented administrative, technical and physical safeguards designed to appropriately protect your Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, no security measures can guarantee that information will never be accessed in an unauthorized way.
If you create an account on our Services, you need to help us prevent unauthorized access to your account by protecting your password appropriately and limiting access to your account. You will be solely responsible for keeping your password confidential and for all use of your password and your account, including any unauthorized use.
Data Retention
We will retain your Information as long as necessary to provide our Services, and as necessary to comply with our legal obligations (including obligations to financial services regulators), resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. We may also retain your Information to investigate or defend against potential legal claims in accordance with the limitation periods of jurisdictions where legal action may be brought.
Children’s Privacy
Our Services are not intended or authorized for use by individuals under the age of 14, and we do not knowingly collect or solicit information from children under the age of 14. By using our Services, you are agreeing to the terms and eligibility requirements contained in the Terms of Service. If we become aware that we have collected information from a child under 14 we will delete that information.
Links to Third Party Websites and Features
Our Services may contain links to other websites or other online services (such as social media platforms), and may include third party features such as apps, tools, widgets and plugins. We are not responsible for these other sites and services; their posted privacy policies (not this Privacy Notice) will govern the collection and use of your information on them. We encourage you to read those privacy policies to learn more about how your information will be used these third parties.
Updates to this Notice
We may change this Privacy Notice from time to time as our business evolves. If we make changes, we will notify you by revising the date at the top of this Notice and, in some cases, we may provide you with additional notice (such as adding a statement to our website or sending you a notification). We encourage you to review this Privacy Notice regularly to stay informed about our information practices and the choices available to you.

This U.S. State Supplement supplements our general Privacy Notice. Residents of certain U.S. states may have the rights detailed below to their personal information (subject to certain legally permitted exceptions). Our general Privacy Notice explains what Information we collect about you, how we collect that Information and how we use and disclose that information. If you are a resident of these states, you should read this Supplement as well as our Privacy Notice to fully understand our collection, use, and disclosure of your Information. Any capitalized terms we do not define in this Supplement are defined in our Privacy Notice.
Your Rights
Your rights as specified under applicable state laws may include the following:
- Access your personal information or receive information regarding our processing of your personal information. You may have the right to access a copy of personal information that we have collected about you or to ask us to confirm whether we process your personal information.
- Correct inaccurate personal information. You may have the right to request that we correct any inaccuracies in the personal information we have collected about you.
- Delete your personal information. Upon your request, we may delete certain personal information we have collected about you.
We do not use or disclose personal information for targeted advertising purposes or for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects on you without either your explicit consent or where otherwise permitted by applicable law.
How to Exercise Your Rights
To exercise your rights to access, correct, or delete your personal information, please send us an email at privacy@cafeteria.com. To prevent fraud and maintain your privacy, we will take steps to verify your identity before granting you access to your personal information or complying with your request. We may ask for additional information such as your phone number and date of birth to verify your identity. You may also designate an authorized agent to submit a request on your behalf. Depending on the nature of your request, we may ask that you verify that the request comes from you such as by requiring a signed written permission from you that authorizes the agent to act on your behalf. A valid power of attorney will constitute signed written permission, but you are not required to obtain a power of attorney to use an authorized agent.
If we deny your request or cannot fulfill it, you may appeal our decision by contacting us via privacy@cafeteria.com to ask us to review your request again. Your email should include “Appeal” in the subject line. You have the right not to receive discriminatory treatment if you exercise any of the rights explained in this U.S. State Supplement.
